| Illegal buildings are the product of the development of our country’s economy and society to a certain historical stage,which has profound economic and social roots.Although many governance measures have been taken in various areas,some results have been achieved.However,illegal buildings cannot be cured.It has always been a stubborn disease in urban management to build and disassemble,and to build and disassemble.As a kind of illegal buildings,community illegal buildings not only have the characteristics of general illegal buildings,but also have their own intrinsic characteristics.In the process of law enforcement,we are facing more complex governance dilemma now.After the implementation of Decree No.37 in 2016,the unification of illegal community buildings is the responsibility of the administrative and law enforcement departments of urban management.Its governance is more centralized and standardized.Moreover,in some places,the administrative law enforcement of urban management has made some explorations on the management of illegal buildings in communities,such as: Meilong Town’s urban management into the community,urban management and public cooperation,Jing’an diversified law enforcement,etc.But in the actual demolition of illega l buildings,there are still many difficulties in law enforcement.The traditional way of governance can’t fundamentally solve the problem of community violation.However,there are few studies on community violation in academia.Therefore,the topic of study is significance both theoretical and practical.This study is based on the theory of multivariate cooperative governance,literature research,comparative analysis,empirical research and normative research are used.The research also deeply studies the challenges,difficulties,and problems in the governance of illegal buildings in the community.The results show that the main manifestations of the governance of community violations are "legal difficulties","reasonable difficulties","emotional difficulties","checking difficulties" and "dealing with difficulties".The finding is that the relevant legal system is still imperfect.Governance of some illegal buildings may be lawful or unreasonable.The implementation of policies and regulations is hindered by various human relations in law enforcement.It is difficult to investigate and collect evidence from illegal buildings.Punishment measures for illegal buildings are difficult to put into effect.Combining with the existing beneficial exploration of governance,specific countermeasures and suggestions are five aspects to put the issues go forward from the sound judicial mechanism,strong prevention mechanism,rapid response mechanism,matching punishment mechanism,and humanized safeguard mechanism.Therefore,the five aspects could provide a reference for the relevant departments to carry out the work for illegal construction governance in the local community. |
