| With the rapid development of urbanization,new opportunities and challenges arise in urban construction.Under the combined impact of multiple factors,such as rapid expansion of cities,inherent drive of various interests,irregular law enforcement and complicated law enforcement environment,the illegal planning problem has become increasingly prominent,resulting in a lot of security risks and social problems.At present,our country has made great progress in the field of law enforcement in terms of planning,and has achieved certain achievements,but many practical problems still exist.A large number of illegal planning activities have not been effectively stopped and punished,causing a serious negative impact on overall urban and rural planning and public interests.This study takes D City as a case,based on the new public service theory and the holistic governance theory,uses literature survey,questionnaire survey,participatory observation and other methods to comprehensively analyze the historical evolution,current situation and existing problems of law enforcement concerning urban management planning,and puts forward suggestions and countermeasures to improve law enforcement of urban management planning on this basis.By analyzing the working mode and achievements of planning law enforcement,as well as the types and harms of illegal planning behaviors,the following problems are found:First,difficulties to crack down illegal planning behaviors specifically when carrying out forced demolition of illegal construction,either to define the impact of illegal planning,or to deal with illegal planning of other collective land.Second,slow operation of law enforcement procedures,manifested by difficulties in investigation and evidence collection,poor coordination between departments,more focus on punishment but less on rectification,especially the hurdles existing in law enforcement involving government-led large-scale projects.Third,lack of internal motivation,relatively insufficient staffing,low professional quality and staff enthusiasm.Forth,inferior law-enforcement-environment for a long time elevating the barrier to effective communication with the masses.The reasons are as follows:First of all,the legal foundation is not solid,that is,the mandatory force authorized by law is not sufficient,the identification standard of unauthorized construction is not clear,and the allocation of legal planning law enforcement authority is not reasonable.Scecondly,incomplete system construction--no institutional guarantee for planning law enforcement has been established,no collaborative law enforcement mechanism has been formed,and no institutional constraints on government-led projects have been established.Thirdly,the team building level is low,which is manifested as limited staffing,low professional identity and lack of positive incentives.Lastly,driven by internal interests of law-breaking subjects.The author puts forward the following countermeasures to solve the above problems: Firstly,strengthen the top-level design and promote special legislation.Including straightening out the urban management system,consolidating the legal foundation,and maintaining the authority of law enforcement.Scecondly,Strengthen institutional construction and straighten out the working mechanism.Focus on promoting collaborative law enforcement,strengthening law enforcement supervision,and implementing the commitment system before the approval of large-scale projects.Thirdly,Focus on team construction,stimulate the vitality of the team,and focus on the "three forces" construction of the team’s willpower,combat effectiveness and cohesion.Lastly,To provide practical guidance to the masses and optimize the law enforcement environment.That is to strengthen legal publicity,consolidate real public participation and implement excellent urban management services. |
