Research On The Management And Control Ofillegal Buildines In The Residential Districts Of Ouzhou From The Persnective Of Urban And Rural Planning

As the level of urbanization increases,illegal constructions are also commonly seen today.In particular,those illegal buildings in the urban residential areas are still far from disappearing despite the fact that they have been strictly punished,and thus have imposed an adverse effect on the implementation of urban and rural planning.Therefore,it has become a common issue for the government and the society to effectively manage the illegal buildings,dispose them legally and appropriately and keep them in a controllable range or even eradicate them,so that social equality and justice can be maintained.Besides,the reasons behind these buildings and the difficulties in management should also be taken seriously,and a deep study and analysis should be conducted to solve these problems.From the perspective of the implementation of urban and rural planning,this paper summarizes such three key problems in the management of illegal constructions as the subject,object and method,that is,who is responsible for the management,what should be managed and how to manage it.On the basis of the relevant research at home and abroad,this paper takes the illegal buildings in the residence areas of Quzhou to study the current situation of the management of the illegal buildings in this city.It selects the specific cases between 2013 and 2019,hoping to figure out the reasons that exist in such three sectors as planning design,planning approval and planning law enforcement.These reasons account for the fact that it is difficult to effectively investigate and eradicate the illegal buildings.The above measures are aimed to dialectically show that the existence of the illegal buildings in the residential areas carries both perniciousness and rationality,and a strict control which is demolishment-oriented has its own disadvantages.At the same time,an analysis is also conducted on the application of law during the investigation of illegal buildings as well as such difficulties as the identification of violation subject,calculation of fine and identification of illegal incomes.Finally,according to the source management of“outer block and inner leading”,this paper centers around four systems,namely,decision making system,enforcement system,feedback system and support system,hoping to build a mechanism for a whole-process planning and management which consists of four aspects,that is,elastic design,dynamic approval,professional enforcement and social governance.It is hoped that such a mechanism can ensure that the illegal buildings can be treated rationally and legally,and thus fundamentally solve the problems in the management and control of the illegal constructions.
