Climate change issues developed along with the path of scientific discovery-political consensus-legal.The debate in the field of natural science did not stop the human pace of looking for common interests,but the international climate negotiation is unpredictable,which seriously affected the legal response to climate change.The agreement gradually became an official article.With the failure of the Kyoto Protocol,the climate order in the new era was urgently to be established,and the “Paris Era” was opened by signing of the Paris Agreement at the twenty-first session of the Conference of the Parties in Paris in November2015,Institutionalized climate change provides two major coping strategies for "mitigation and adaptation".With the development of reason,people are gradually realizing that "mitigation" of climate change is a manifestation of human conceit,and will focus on "adaptation "," Paris agreement " " top-down " development model of the change requires "adaptive " rational return.The "adaptability" of the "Paris Era" climate change law is mainly based on the theory of "adaptability" and focuses on developing a favorable system for the Kyoto climate mechanism in the new era.Building on the United Nations Framework Convention on Climate Change,the Kyoto Protocol,the Paris Agreement and other international climate instrument,and seeking out the focal points for the continued development of the climate regime of the Paris Era,and strengthening cooperation under liberalism,To enhance national capacity to adapt to climate change.The article analyzes the difficulties of the "Paris Era" climate change law,the lack of response to dissect the traditional legal system,the limitations of "adaptation" in the Paris Agreement,and the lack of confidence of the parties in fulfilling their international obligations.To explore the "tragedy of Commons",market failure,democratic failure and other deep challenges facing climate change,and then put forward the response direction of the "Paris Era" climate change law.Therefore,the climate mechanism of the "Paris Era" needs to strengthen the concept of "adaptability",correctly understand and rationalize the various subjects of the climate change law,and expand the response mechanism for climate change in the "Paris Era".We will integrate domestic climate legislation and national climate policies under international climate rules and promote them in conjunction with corporate actions and the activities of non-State actors.At the same time,we need to use the rational regression of the concept of "adaptability" and the "adaptability" of the principle of sustainable development to construct a multi-level climate governance subject pattern,and realize the "adaptability" of the subject rule in the understanding and implementation of the "Paris Agreement".The Kyoto Protocolhas creatively provided carbon sinks and carbon trading mechanisms for climate change responses,and while direct trade and offsets are not currently appropriate,the cooperation highlighted in the Paris Agreement will continue to contribute to the development of carbon markets,This calls for a useful expansion of the traditional three mechanisms of Kyoto,and a long-term consensus to address "carbon leakage" throughout the world.
