Research On Rights Protection Of Digital Information Service Under The Network Environment In China

Digital information service is concerned by research field both home and abroad in recent years. The sharing and using of space-time spanning digital information have caused, under the network environment, fundamental changes of the rights and interests relationship and service method in information service organizations. The rights and interests conflicts between the owners, service providers and users, with country and public as well, on information in digital information service are becoming sharper day by day, which certainly brings us new tasks and challenges: How to establish a effective protection framework on the rights and interests of the digital information service under the network environment in china, so as to protect every part's rights and interests in digital information services.Based on the theory of systemic,with research and survey on both internal and external material and data, studying on the actuality and practical problems of the relation and protection of rights and interests in the digital information service in network environment, this paper aims to establish a system of rights and interests protection in accordance with the digital information service reality in china under the network environment.First, beginning with meanings explanation of the digital information service on Internet, this paper compares digital information rights and interests protection with the traditional one,with the classification of protection objects in digital information services. Second, it brings forward the basal principles on protecting digital information service rights and interests on the analysis of the main contents and characters of digital information service rights and interests protection. Third, this article reviews the progress made in insuring digital information service rights and interests in China with problems as well. And at last, based on the reference of successful oversea experiences, the paper seeks in building a digital information service rights and interests protecting framework from four aspects as law and regulations, digital technic,the policy of measures and information ethic, which supply and cooperate with each other, to provide with a powerful ensure in digital information service rights and interests, and furthermore, with an available service on the benefits balance keeping in network resources utilization.
