Research On The Legal Countermeasures To Optimize The Rural Judicial Environment

As a concrete implementation link of national law in rural dispute settlement,rural justice embodies the judicial attitude of national law in dealing with rural disputes.It is an indispensable link in the construction of the rule of law at the grass-roots level in China,and its perfection is the key point of rural grass-roots rule of law construction.Although the rural judicial practice has been gradually achieved in the support of the state and various sectors of society,there are still many problems in its actual operation.On the basis of the systematic exposition of the rural social changes,from the rural judicial environment,through the statistical arrangement of the relevant data of rural judicial practice,and the comparative analysis of the rural judicial environment and the urban judicial environment,the internal and external environment of rural judicature is clarified,and the rural judicial environment is found in the current judicial environment.Under the restriction,there are still internal and external problems.That is,the current judicial work mechanism can not fully adapt to the needs of the rural society and other worries,there are misunderstanding of the villagers’ understanding of the law,and the improvement of the rural judicial environment is still a very difficult problem.On the basis of this study,combined with the practice of rural judicial operation,from two aspects of the rural judicial environment,the author proposes that the rural judges should give consideration to the dispute settlement and judicial transport in the judicial process,improve the way of entering the judicature,strengthen the introduction of legal personnel and improve the rural law.In order to broaden the way of thinking for the research of rural judicature in our country,it is beneficial to the development of rural judicature in the theory and practice of our country.
