Research On The Path Of Legalization Of Environmental Protection Supervision System

Traditional bureaucratic environmental protection agencies perform the function of environmental protection supervision,but the actual effect is not satisfactory.Faced with more and more serious environmental pollution,the emerging environmental management problems increase the difficulty of supervision.Problem oriented,general secretary of the CPC central committee,the central environmental protection supervision system was introduced,the power to prevent and control pollution,focusing on pollution prevention to be completed,promoting the construction of ecological civilization is the important institutional arrangements,so far three finished the first round of the ecological environment protection and supervision in work and "look back",in 2019 will start the second round of the ecological environment protection and supervision.The central environmental protection inspector has helped solve more than 70,000 ecological and environmental problems around the people,promoted the environmental improvement of centralized drinking water sources nationwide,and firmly pushed forward the battle of blue sky protection.However,the central environmental protection supervision system has not been established for a short time and has not yet established a perfect mechanism.At present,there is little research on the theory and law of the supervision system,and no operable theoretical system has been formed.In order to improve the environmental supervision system and provide theoretical support for environmental supervision institutions in winning the battle of environmental protection.In this paper,by referring to the data of the environmental protection supervision system in the past two years and applying the research thinking of jurisprudence,the author tries to realize the long-term and long-term treatment of the environmental protection supervision system through the rule of law.This paper adopts a variety of research methods,draws lessons from the supervision system at home and abroad,especially the land supervision system of Russia,which has important reference significance for China to improve the supervision system.Similarly,the comparative analysis of China's land supervision system,tax supervision system,police supervision system long accumulated good experience,and combined with the particularity of China's environmental protection supervision system and the operation of more than two years to show the need to improve the local rectification,environmental protection supervision related legal system arrangement more perfect.In this paper,the plight of environmental supervision system is facing the lack of rule of law as the entry point of this paper,through the analysis of environmental supervision in practice and the performance of the plight of the system and the reasons to find solutions to improve the process of environmental supervision rule of law.The first part of this paper analyzes the status quo of environmental supervision system,including the status quo of legislation and practice.Environmental protection supervision system in our country related legislation,law enforcement according to the status is low,style needs to improve the problems of practice system of environmental protection supervision showed great superiority,made great achievements in environmental protection,the process of advancing the great cause of environmental protection,but there are still some problems,find the problems of the environmental supervision system is to find the breakthrough point and focus of solving the problem,then the author analyzes the environmental protection supervision system in practice and the difficulties and the causes of institutional,make measures to suit the remedy to the case,hit the nail on the head.The predicament of the environmental protection supervision system in practice is the false rectification,perfunctory rectification and so on.The institutional dilemma is reflected in such problems as imperfect legal system,low level of legislation,unclear system positioning and lack of mandatory right of punishment and suggestion.The causes of the dilemma of environmental protection supervision system are mainly manifested in the local government's economic man choice,local protectionism,rent-seeking behavior,and economic priority performance appraisal.The second part of this article mainly analyzes the process of the supervision system construction at home and abroad.Russia's land supervision system and China's land,police and tax supervision system are of positive significance to the construction of environmental supervision system.The third part of this paper puts forward the scheme of legalization of environmental supervision system.Need to perfect the system arrangement,from realizing inner-party laws and regulations and administrative rules and regulations of the scarf and synergistic,standardization of environment supervision legislation system,perfecting the supervision system of the organizational structure and management system,improve the working mechanisms of environmental supervision institutions,improve the environmental protection supervision accountability mechanism,perfecting the environmental supervision accountability mechanism,improve the environmental protection supervision power supervision mechanism,establish a scientific and standardized environmental supervision accountability procedures,improve the relevant supporting measures,etc.
