Research On "Party And Government Sharing Responsibility" For Ecological Environmental Protection

For a long time,the party ’s leadership of the country and society in various fields is mainly reflected in the macro level of policy and policy guidance,basic little direct intervention in the micro level of social public management,so "party and government responsibility" is the party’ s leadership mode in the field of the rule of law responsibility of a great change,is also the country to comprehensively deepen reform and promote the modernization of national governance ability.After the 18 th National Congress of the Communist Party of China,ecological progress was included in the "five-pronged" overall layout,and coordinated with economic,political,cultural and social development.The reason why China puts ecological and environmental protection in the top priority of national work is because the current environment situation is quite serious and has endangered the people’s survival.In the past,China only emphasized the environmental responsibility of the government,while the environmental responsibility of the Party committee organs that have mastered the final decision-making power has been wasted.However,the ecological and environmental crisis is not enough for China only to rely on the power of the government,and the environmental problems still exist and even become more and more intense.Therefore,it is imperative to introduce the "party and government equal responsibility" system for ecological and environmental protection.In order to strengthen supervision over ecological and environmental protection,the state has formulated a series of documents such as laws and regulations,inner-party regulations and normative documents,which serve as the standard basis for the operation of the "Party and government equal responsibility" system for ecological and environmental protection.The system of "the same Party and government responsibility" for ecological and environmental protection mainly includes the supervision mechanism of ecological and environmental protection,the target evaluation and assessment system of ecological civilization construction,and the lifelong accountability mechanism for ecological and environmental damage.The above three mechanisms ensure the implementation of the ecological and environmental responsibilities of Party committees and governments,providing institutional support for improving China’s environmental situation.At present,in the operation process of the "same party and government responsibility" system of ecological and environmental protection,China is mainly based on the normative documents jointly issued by the CPC Central Committee,the State Council and other Party and government organs,but these documents have defects in unclear legal attributes and lower effective order,leading to the ununity of applicable standards in the process of accountability.Although China has constructed the "party and government responsibility" system,in the process of ecological and environmental damage,the division of party and government environmental protection,and the environmental protection responsibilities are unclear,the responsibilities of the environmental protection department and the weak.In order to implement and implement the system of "the Party and Government" for ecological and environmental protection,we should further improve the environmental responsibility provisions in the law,formulate high-level norms;improve the relevant provisions in Party regulations and normative documents,and pay attention to the connection and coordination between inner-party laws and regulations and national laws.We should build a diversified ways to launch accountability,and improve the "same accountability of the Party and government" by strengthening "heterogeneous accountability".Clear the responsibilities of the Party and government,clear the distribution of responsibilities,and reasonably allocate the responsibilities between the government and its departments.Improve the level of environmental law enforcement and supervision by local Party committees and governments,and establish a sound environmental supervision system to strengthen the law enforcement and supervision of environmental protection.
