Research On Government 's Environmental Responsibility

Environment problems in China has focused the most attention of common people. In Chinese environmental legislation, corporate is always the main responsible party to an environment event. However the environment of China is becoming worse. Thinking about the environmental events recent years, people found government played a very important role in them. The newly revised Chinese Environment Protection Law emphasized the government responsibility on environment protection, aimed to prompted the government to take its responsibility to the environment. Only after few months of the enactment of the law, the pollution of Tengger Desert was exposed. Through the procedure of the local government dealing with this events, the situation of the Chinese local government’s negative attitude and regulatory loopholes to environmental protection.,which seriously affect the process of China’s environmental governance. The implementation of government environmental responsibility has become the first problem to be solved in the process of controlling environmental problems.The topic of this thesis is how to make the government take its environmental responsibility actively and positively during the implementation of the newly revised Chinese Environment Protection Law. A healthy environment is a public welfare. The government as the public management has the responsibility to protect the environment and the obligation to provide a good living environment for the public. It has the power to organize and allocate public resources, it has the responsibility and ability to take the environmental responsibility, to protect the ecosystem. However, the reasons for obstacle to implementing the responsibility can be divided into two aspects. On the one hand, in government administration system, the Tax-sharing system, the close profit relationship between government and enterprises and the unable social supervision affect the government to perform; on the other hand, they are the defects of the newly revised Chinese Environment Protection Law, such as the level of the law is not enough to be a basic environmental law and accountability system lacks efficiency, aggravated the implementation difficulty of the law. This thesis puts forward some suggestions, in the aspect of the administrative management, increasing the proportion of environmental protection in the transfer payment, moderately stripping the interests of government and enterprises and improving the degree of information disclosure; in the aspect of the Law, clearing the government’s environmental boundaries, refining the accountability mechanism and the relevant legal system. Hoping that this thesis will make a contribution on the implement of the government environmental responsibility of the new environmental law.
