Study On The Legal System Of Government Supervision Of Third Party Control Of Environmental Pollution

The concept of “third party control of environmental pollution” was first formally proposed in 2013,the third plenary session of the 18 th “on comprehensively deepen the reform of the central committee of the communist party of certain major issue decision”.Third party control of environmental pollution is the highest degree of marketization,specialization,the most professional environmental pollution mode,it is helpful to decrease the cost of government environmental regulation and enforcement costs,improve the effect of pollution control,attract social capital go to the eco-environmental protection market,thus to foster more Chinese environmental enterprises,so that make China's environment is really going to improve.The advantages of third party control of environmental pollution must be based on the strict government supervision.But in practice,due to lack of matching legal system,government supervision has encountered problems,such as inadequate government supervision resources,virtual placement of mechanism of supervision liability,malpractice in environmental supervision and so on.It poses obstacles to comprehensively advancing third party control of environmental pollution.Therefore,the improvement of the legal system of government supervision of third party control of environmental pollution is a problem that needs urgently be solved before all citizens.This paper begins with the basic conception of third party control of environmental pollution and the legal implication of government supervision,and researches the government supervision of third party control of environmental pollution.Through case analysis,this paper expounds the actuality,problems and cause of the third party control of environmental pollution in China.And from the foreign government's advanced experience in government supervision of control of environmental pollution,this paper makes a preliminary analysis on how the government can play a supervisory role in the third party control of environmental pollution.Finally,proposes the countermeasures,such as enhance the operability of existing environmental laws and regulations,establish effective vertical supervision and territorial control systems,perfect the legal system of accountability of environmental supervision,establish the environmental credit evaluation system for the third party enterprises,disclosure information of government supervision,and so on.
