Study On The Legal System Of Ecological Compensation For Mineral Resources In China

Mineral resources as an important material basis to maintain the survival and development of mankind,but with the rapid development of social economy,mineral resources have been gradually exploited because of their great economic potential,and the phenomenon of irrational exploitation and utilization is becoming more and more serious.It not only damages the ecological environment,but also restricts the development of social economy.It is an inevitable choice to solve the problems of ecological environment and social development caused by mineral resources and perfect the legal system of ecological compensation of mineral resources.The theories of environmental right and externality lay a theoretical foundation for the legal system of mineral resources ecological compensation.There are a series of problems in the current ecological compensation system of mineral resources in China,such as the orientation and distribution of taxes and fees,the implementation mechanism of ecological compensation,the fund and the supervision system,etc.,which seriously hinder the exertion of the utility of the ecological compensation system.Referring to the relevant legislation and practice of foreign countries,the author holds that China should establish a special legal system of ecological compensation for mineral resources,further standardize the orientation and distribution of taxes and fees,and perfect the corresponding implementation mechanism of ecological compensation.And provides the corresponding fund guarantee for it,in the scientific and reasonable way to the mineral resources ecology The compensation system is supervised to promote the construction of ecological compensation system for mineral resources in China and to realize the effective protection of the ecological environment of mines and the rational exploitation of resources.
