Research On The Legal System Of Mineral Resources Exploitation For Ecological Environment Restoration

The exploration and exploitation of mineral resources promotes the economic development of our country,but the negative effect brought by unreasonable mining behavior is more worthy of our attention.The over-exploitation of mineral resources causes a series of environmental problems,which seriously affects the living environment and even the living environment of the surrounding residents.At the present stage,the ecological environment caused by mineral resources development in China is increasingly serious,such as: the collapse of the earth's crust,sewage discharge,air pollution and other problems must be treated systematically,effectively and critically.If not handled properly,conflicts with local residents will be aroused,which will lead to a series of social problems.In the report of the 18 th national congress of the communist party of China(CPC)central committee,it was clearly proposed to promote the construction of ecological civilization.At the same time,in order to solve the adverse impact of the ecological environment in mining areas,the government has carried out restoration work for the ecological environment in mining areas.For mineral resources development in our country,however,there is no specific legislation of ecological environment restoration,who left over from history of the mine restoration,acceptance criteria,how to supervise work how to perfect the detailed provisions,in the development of mineral resources,the ecological environment restoration in the practical work,but also exists as,not as a problem,make the country according to the mining area ecological environment restoration has become a mere formality.At present,how to reduce the environmental problems caused by the exploitation of mineral resources,how to ensure the living environment of local residents,how to make people live in harmony with nature,and how to realize the sustainable development of social economy have become the serious problems facing the ecological environment restoration of mineral resources exploitation in China at the present stage.This paper analyzes the defects in the legal system of ecological environment restoration of mineral resources development in China from the perspective of law,and how to solve the problems that may be faced in the process of restoration.This article from four parts in this paper,the development of mineral resources,the ecological environment restoration of the legal system of the study,the first part is the analysis of the present situation of mineral resources development and ecological environment in China,and many scholars on the understanding of the mineral resources development and ecological environment restoration overview,further study on the connotation of mineral resources development and ecological environment restoration,including the definition of basic concepts.The second part is an introduction for mineral resources development in our country's rules of ecological environment restoration,from the perspective of the legislative,judicial,legal system in our country,the supporting system is not sound,including repair fund setting,acceptance,repair the main body of standards and responsible for repair and repair supervision lead to mineral resources development and ecological environment restoration in facing the reality of the problem.The third part is to introduce the foreign system for mineral resources development and ecological environment restoration,as well as the mature theories and remarkable achievements in the management work.The fourth part is to put forward Suggestions for China's mineral resources development and ecological environment restoration,which not only needs special legislation,but also needs to improve the relevant legal system,implement responsibilities in practice,set reasonable restoration standards,let the public take the initiative to participate in the supervision,and achieve the sustainable development of man and economy,man and nature.
