Research On Ecological Compensation System For Mineral Resources Development

As an important part of the law system,the system of ecological compensation can solve the contradiction between development and protection.It can also address the issue of fairness.In a broad sense,ecological compensation can be divided into two types: compensation for increased ecological benefits and compensation for ecological damage.The ecological compensation for mineral resources development belongs to the latter.The resource development process makes negative ecological effects.Mining enterprises should properly compensate those who protect the environment.In this way,the environmental damage and economic backwardness can be made up.However,it is still controversial whether to recognize mineral resources as the legal type of ecological compensation in theory.This paper holds that mineral resources development process also conforms to the fairness,coordinated development and unification of Rights and obligations.Meanwhile,mineral resources have the characteristics of non-renewable and damaging diversity.As a result,even the legal mining behavior will also cause the individuals.Mining enterprises should be more reasonable exploit mineral resources for the sake of ecological protection.According to the existing laws and relevant practices of the ecological compensation system for mineral resources development in China,there are some problems.The first problem is that the law is unclear.The second problem is the way of compensation is simple.There are also problems with compensation bodies and financing.In order to establish the system of ecological compensation for mineral resources,we should set up ecological compensation system on the basis of human benefit.We should promote the legislative process of ecological compensation.Firstly,we should rationally define the rights and obligations of the compensation and the compensated subjects.Secondly,we should establish the financing mechanism that combines the government with the market.Thirdly,we must form a supervision system that combines government supervision and social supervision.
