Research On Problems Of Network Right-safeguarding

This paper is about research on relevant problems of network right-safeguarding.The purposes of it lie in abstracting the elements of the concept of networkright-safeguarding, analyzing its character, at the same time, reviewing the reason andbidirectional function of this mechanism, pointing out its actual problems andsumming up corresponding strategies. We understand easily the concept of networkright-safeguarding in virtue of introducing network appealing. Several key factors areinvolved in the extension of network right-safeguarding, namely, sources, approaches,cases and objects. Relating to network, network right-safeguarding shows its uniquecharacteristics, that is, virtuality, concealment, safety, openness, timeliness, low costand fast returns. The rise of the mechanism has five reasons: it is easy to operate, canbreak through local protection net; web has the function of creating public opinions;governments pay much attention to network public voices; the existentright-safeguarding mechanism is not perfect. The positive functions of networkright-safeguarding are: arousing the regard of relevant parts to realize the rights andthe attention of governments on Disadvantaged group; good for netizens to carry ontheir rights on corruption cases and judiciary innovation; speeding legislation courseof some act. The negative parts lie in: illusory network right-safeguarding which maycause network crook or decline of reputation of certain citizen, organization,especially to governments; human flesh search which may bring in tort obligation andmoral crisis; striking formal right-safeguarding mechanism. From the negativefunctions, we can summarize some problems caused by network right-safeguardingitself, the people who are intend to safeguard their rights, the net flat roof and law.Each of them has specific and relevant solutions.Network right-safeguarding is also called public opinion right-safeguardingbecause it has some relationship with media and public opinions. On the backgroundof We-Media which is turned on by micro log, the effect of right-safeguarding of netizens is enhanced. It is a new angle of view to have research on right-safeguardingthrough media on network age.This paper means to discuss a new way to safeguard rights via network and theproblems it may generate. During the process, the author use network messagecommunication and ethics for reference and take case study, comparative andsemantic analysis methods in order to provide non-system support for legalconstruction. Network right-safeguarding is not all about right-safeguarding. It needsto consider other ways to safeguard rights better. The build of network flat roof, thecultivation of the network right-safeguarding consciousness and common senses andstrengthen of moral and ethic of people and filling up the blank of the law are allvaluable when mentioning network right-safeguarding.All in all, it has a huge room for researching on network right-safeguarding.
