《Postal law of the People's Republic of China》(for short《Postal law》),which is rough revised for ten years,has been deliberated to pass through by the National People's Congress on April 24,2009.This widely concerned law which is like the leader of postal service,including universal postal service, postal monopoly in etc is of concern to all social circles,is settled down at last.This《Postal law》has broken through in legislative for postal monopoly's regulation,but there is still missing and regret in the institution of universal service postal monopoly that is due to the huge disputing,quick coming on and inherent shortage.these lead our country's question of postal monopoly hasn't come to the final opinion or the state council standards come on yet.This article through to the national postal regulations by comparative analysis of China post, the overall development of the environment that the SWOT analysis, solve the existing conflicts and omissions, the urgent task should be speeded up the pace of formulate laws and regulations system, reference to other countries and regions by postal monopoly in system of regulation, clear postal monopoly in legal status and the determination of reasonable monopoly in scope, the establishment of a more perfect postal monopoly in system. To promote universal postal enterprises improve service quality and dispersive risk, protect a user rights, so as to consolidate the postal law being the fundamental guarantee universal postal service.
