Research On Legal System Of Sustainable Use Of Groundwater Resources In China

Water crisis is a major problem in the world and how to make the water resource be protected reasonably is a hard question faced by all the countries. In China, how to rationally develop and protect groundwater resource, which is an important component of water resources, have been neglected, especially lacking relative legal system. From the legislative level, the current protection for groundwater resources apparently cannot deal with the more and more serious problems which groundwater resource are facing. Although the existing legal system play a certain role in the protection of groundwater resource, the legal system is plagued with problems such as the not smooth management system, the water-drawing permitting system and the mechanism of underground drinking water source protection zones as well as over exploited groundwater's management.This article begins with the analysis about the water resource in China and sums up the difficulties that the sustainable use of groundwater resources are facing, then proposes the core issue of this article, that is the legal system of sustainable use of groundwater resource.Form the introduction about the legislative experience of U.S., EU and South Africa, we can learn a lot about the groundwater recharge and groundwater resource evaluation system. For example, South Africa have guaranteed the ecological environment water beside the water for basic needs, and effectively protect the groundwater environment. The EU's assessment for groundwater resources values all risks the groundwater resource may encounter, which more effectively make groundwater resource be used sustainably.The legal system of groundwater resource sustainable use in China can be improved form five aspects.First, the groundwater resources management system shall be uniform and efficient.Second, Abstraction permits shall be consolidated and Supervision shall be strict.
