Legal Regulation Of Rural Groundwater Resource Protection System

Water resources is basic to human survival and development, groundwaterresources is an important part of the water resources. With the acceleration of theprocess of the development of China’s rural economy and rural urbanization,groundwater resources in rural areas is facing increasingly serious challenges.Becauseof unreasonable exploitation and utilization of groundwater resources has led to thegroundwater resources of the rural areas in China are subject to varying degrees ofdamage, has been a threat to people’s health. However, the legal protection ofgroundwater resources in rural areas in China is mainly scattered in theEnvironmental Protection Act, Water Act, the Water Pollution Control Act, as well asprovincial and municipal local legislation and other laws and regulations, and suchlegislation exists legislative level notclear, the lack of long-term unified managementsystem, the lack of a corresponding liability provisions and no special legal protectionof groundwater resources in rural areas, these issues seriously restricting the legalprotection of the rural groundwater resources in China. Therefore, the need to buildand perfect the legal system of China’s rural groundwater resource protection.This paper is divided into three parts to elaborate on the problem. The first part isthe analysis of the theory and the concept, and legal basis for protection ofgroundwater resources in rural areas, while the use of the comparative analysis of theconcept of rural, surface water and groundwater resources. Analysis of the theoriesand concepts will help us to better grasp the problem. The second part focuses on theanalysis of the law and the problems of the rural groundwater resource protection, theperspective of the relevant provisions of the current Constitution, laws, administrativeregulations, administrative regulations, and local laws and regulations and other lawsand regulations on the protection of groundwater resources in rural areasinadequacieswhich exist in the current legislation in China. Because of the deficiencies of thecurrent legislation for the protection of groundwater resources in rural areas, therefore,the third part is focused on to explain how to solve the problems which exist in reality,groundwater resources law proposed to build, improve water conservation system, establish and improve rural groundwater resources in emergencysystem, improve themonitoring system of groundwater resources in rural areas, to establish long-termgroundwater resource management system and the strengthening of the legal liabilitysystem as well as improve the law enforcement team,improve the relevant legalsystem to achieve the purpose of the protection of the rural groundwater resources inChina.
