Research On The Issue Of Legal Protection Of Groundwater Resources In China

Freshwater resources is an important factor for ensuring economic development and social progress, it is essential natural resources for national development, protecting groundwater resources plays a key role for a national comprehensive development. Along with rapid development of our country economy, rapid growth of population leads to rise in per capita water consumption, the emission of industry, agriculture and domestic sewage leads to the quality of groundwater deterioration. The groundwater pollution have occurred a lot of incidents since2013. It is visible that the problem of groundwater pollution in our country has become increasingly seriousness, so it is urgent to solve the problem.The rational use and protection of groundwater resources is vital task of the world and it is the first priority for countries environmental governance. Therefore, starting with the current pollution situation of legal protection of groundwater resources in China, the author has analyzed the existing problems and causes of the legal protection of groundwater resources. From the analysis of legislation, the existing main problems are existing legislative model confusion of groundwater resources, the lack of a special law of groundwater protection, the lack of legislation operability, the legislation content absence of groundwater resource tax and so on. From the analysis of the legal system, the legal system related to the groundwater resources protection is imperfection at present, there are some problems need to be solved. For example, the exploitation system of the groundwater resources, the artificial recharge system,the water right transfer system of groundwater,the evaluation and monitoring groundwater system and so on. From the perspective of management system, the administrative confusion and responsibility are not clear, the model of each department multiple management is adverse to effective protect groundwater resources. To solve above problems, through reference from typical foreign countries in practice and legislation of legal protection of groundwater resources, it puts forward the legal countermeasures to solve the protection of groundwater resources in our country. Our country needs to develop a special protection law of groundwater at present, carry out groundwater resources tax system actively. Meanwhile, we should improve the related legal system for groundwater resources protection, straighten out the administrative system of groundwater resources, definite the groundwater protection department responsibility and authority, strengthen the administrative law enforcement of groundwater resources. Through the analysis and study of the above problems, combining with the actual situation about protection of groundwater resources in our country now, trying to build and improve our country legal protection system of groundwater resources, vigorously promote the legal protection of groundwater resources in China, ultimately achieve sustainable development and utilization of groundwater resources in our country.
