Groundwater Resources Protection Legal System

Resources facing the exploitation in above quota of groundwater in the current, our countryecological environment has destruction, pollution, and groundwater serious problems. To protectgroundwater resources sustainable use, we need to perfect the system to protect groundwaterresources. In this paper, by analyzing the theory and analyze the current problems of groundwaterresources protection system in our country, and targeted put forward perfect measures. Full-text isdivided into three parts.The first part, the introduction of the concept of groundwater resources and groundwaterresources are faced with the problem, and the groundwater resources protection legal systemproblem for further expansion. Mainly includes three aspects. One is the introduction of the conceptof groundwater resources, and discusses the relationship between groundwater and groundwaterresources, introduces the characteristics of groundwater resources. The second is to discuss thecurrent face damage such as overdraft, pollution of groundwater resources in our country problemsand causes of the damage. Three is based on the legal system of groundwater resources in ourcountry, the legal system of protection of groundwater resources problem for further development,proposed our country of ternary system of deconstruction of groundwater resources, groundwaterresources protection goals and the core issue of groundwater resources protection system. Throughthis part of the introduction and the discussion, we know clearly about the protection of groundwaterresources protection object, in view of the problems, goals and protect system to solve the coreissue.The second part, discusses the basic legal theory of groundwater resource protection.Groundwater resource is a public required by the production and living resources, the current mainformed the two basic legal theories to protect groundwater resources, one is the continental lawsystem countries public property theory, the theory of public trust in common law countries.Through introduction and comparison of the two theories, we can conclude, with publicity ofgroundwater resources, its legal attribute is very complex, on the groundwater resources there areboth executive power, and the public rights, and property rights, the government and the publicsurrounding ground-water formation complex legal relations. Through this part of the research, werecognize the groundwater resource in the law has special legal status, how to arrange for us toprotect groundwater resources, administrative management and public access provides a train ofthought. The third part, the problems existing in the evaluation of groundwater resources protectionsystem in our country, and perfect countermeasures and Suggestions are put forward. Protectionsystem existing problems and counter-measures of groundwater resources mainly include fouraspects, one is that we don’t treat the supply water of guaranty by government and the commercialutilization water, regardless of the resulting administrative department or the one-sided pursuit ofeconomic development goals and ignored the equal use of public rights and interests, or themanagement had to die rather than to the rational allocation of water resources by marketmechanism. All affordable water supply system should be established and available water amountaccording to each region can be divided into government-subsidized water supply and commercialwater, according to different rules. Second, is groundwater resources management system of theexisting problems of performance management in diversification and lack of the system to allowpublic to participate. The corresponding should centralize management and improve the publicparticipation mechanism. Three is system of ground-water resource development and managementof the existing problems, the current main there are imperfect monitoring system, water intakeengineering management and the management system of the artificial recharge is imperfect. Weshould improve the system of monitoring of groundwater resources, water and artificial rechargeengineering management system management. Four is the pollution of groundwater resourcessystem is missing, should pass legislation to improve the system of pollution control of groundwaterresources.
