Research On China’s Data Security Governance Policy From The Perspective Of Policy Tools

Under the ever-changing development trend of digital information technology,data has gradually become the backbone of production and life in the new era.In April 2020,the State Council issued the "Opinions on Building a Better Market-Based Allocation System and Mechanism for Factors" for the first time at the national level.The fifth largest factor of production after land,labor,capital and technology.Data security governance has increasingly become an important cornerstone to ensure the economic development,social stability and national security of various countries.In order to seize strategic opportunities in the global digital transformation competition and provide a benign and orderly development environment for the development of emerging data-based industries in the country,countries around the world have Accelerate the top-level design of data security governance,and speed up the preparation and release of relevant laws,policies,standards and norms.Firstly,this study adopts the literature research method to identify and analyze the concepts and types of policy tools and data security governance,and then sort out the domestic and foreign literature on data security governance,and comment on the research results.After investigating the types of policy tools,the classification methods of Roy Rothwell and Walter Zegveld policy tools are selected,and the theoretical framework of the policy tools is quoted.Secondly,use the network investigation method to collect and sort out the policy texts of my country’s data security governance theme,and analyze the development process of my country’s data security governance policy and the main body of policy release.Create a high-frequency word cloud based on text content,and extract data security governance objects from the word cloud,including national data security,enterprise data security,and personal data security.The five types of data security governance are government data security,industrial data security,and medical data security.,financial data security,car networking data security.After that,a two-dimensional analysis framework for policy tools was constructed with two dimensions of "policy tools-data security governance".The dimensions of policy tools are divided into three types of policy tools: supply,demand,and environment.Personal data protection,data content management,and data market The four levels of governance and cross-border data exchange constitute the dimension of data security governance.After coding the policy text,a two-dimensional cross-application analysis was adopted,and the characteristics of policy tools were discussed.The use of environmental policy tools is dominated by regulatory tools,supply-oriented policy tools pay attention to infrastructure construction and scientific and technological support,and demand Type policy tools focus on trade controls and international cooperation.Based on the results of the basic analysis and content analysis of the policy texts above,the final study shows that my country’s data security governance has five problems,such as unclear governance organization structure,insufficient policy support in terms of funds and talents,and the need to improve financial tax policies.Governance top-level design,attaching importance to professional personnel training,increasing capital investment,relaxing preferential tax policies,strengthening data security supervision and management,and raising the awareness of data security protection in the whole society are five policy recommendations.
