| Public health emergencies pose a serious threat to economic and social development and public health.Big data technology,supported by personal information,plays an important role in epidemic prevention and control and government governance during this pandemic.Because of the advantages of early warning and prediction of personal information epidemic,local governments and other personal information collection subjects have also made extensive collection and use of citizens’ personal information in many ways in order to control the epidemic.However,the use of a large number of personal information has also caused the problem of personal information disclosure,which has violated the rights and interests of personal information,leading to the frequent occurrence of various cases of infringement of personal information rights and interests.While giving full play to the advantages in the early warning and prediction of personal information epidemic situation and the mobile monitoring of key populations,local governments and other personal information collection subjects,in order to give priority to protecting the public interest,widely collect and use citizens’ personal information by combining online anti epidemic applications such as health codes and electronic passes with offline multi-channel,which has effectively curbed the epidemic situation of New Coronary Pneumonia and triggered the disclosure of citizens’ personal information Track exposure and other "secondary disasters".To clarify the boundaries of personal information collection,utilization,disclosure,and sharing in the event of a public health emergency,this article first explores the similarities and differences in the nature of personal information between normal times and public health emergencies,highlighting the characteristics of personal information during special times.It then explains the legitimacy of the restrictions on personal information during epidemic prevention and control,and suggests that in the event of a public health emergency,personal information protection should be considered while prioritizing public interests.Next,based on the current situation of personal information protection in public health emergencies,this article analyzes the problems in the process of information collection,use,and disclosure,such as the chaos caused by the diversification of information collection subjects,unclear regulations on the rights and responsibilities of collection subjects,insufficient specifications in the public disclosure process of personal information collection,and unclear avenues for personal information protection and relief.Drawing on relatively mature theories and practices from abroad,this article proposes four improvement suggestions from the perspectives of clarifying the rights and responsibilities of information processors,strengthening the supervision of the procedures for personal information disclosure,clarifying the principles of responsibility for personal information infringement cases,and establishing specialized institutions to ensure the supervision and relief of personal information protection. |
