Personal Information In The Prevention And Control Of Public Health Emergencies Protection Research

With the vigorous development of the information society,personal information,as an important social resource,plays an important role in various fields,and the establishment of digital government is the product of the information age.In administrative management,by collecting and analyzing all kinds of information and data,administrative organs can improve efficiency and provide better public services for the society.However,while we enjoy the information dividend,we are also faced with many risks of information disclosure and abuse.During the COVID-19 response,the government’s collection and use of personal information,on the one hand,is conducive to monitoring and prevention of the epidemic,but on the other hand,there have also been many personal information leakage incidents.Admittedly,in the face of the maintenance of public interests,personal interests need to make appropriate concessions,but such concessions also have their boundaries.In the prevention and control of public health emergencies,the development of information technology and the exercise of administrative emergency right have caused some difficulties to the protection of personal information,which makes the citizens’ personal information rights and interests unable to be effectively guaranteed and relieved.In the prevention and control of public health emergencies,how to ensure the collection and use of personal information by administrative organs to operate within the track of the rule of law and ensure the safety of personal information has become an urgent problem to be solved.Therefore,the text mainly takes public health emergencies as the background to study the protection of personal information right,in order to provide suggestions for the protection of personal information in the prevention and control of public health emergencies in China.As for the research on the protection of personal information right in the prevention and control of public health emergencies,the main thread of this paper is to follow the sequence of the development of things,deeply analyze the causes of the events,and finally find out the solutions to the problems.The main body of this paper studies the protection of the right to personal information in the prevention and control of public health emergencies from the following four chapters.The first chapter is an overview of public health emergencies and the right to personal information.This chapter mainly elaborates the basic concepts and characteristics of the right to personal information and the right to public health emergencies.In addition,the definition,characteristics and information rights of personal information in public health emergencies are further expounded.The second chapter expounds the prevention and control of emergent public health events in the restriction and protection of personal information rights legal basis,this chapter firstly discusses the prevention and control of emergent public health events in restricting the right of personal information,principles and its limit,then further analysis of public health emergencies prevention and control of the theoretical basis and necessity of protecting the right of personal information It also points out that the ultimate purpose of restricting the right to personal information is to better protect the right to personal information of citizens.In addition,it also investigates the relevant legislative situation and experience of personal information protection outside the region.The third chapter for public health emergencies prevention and control of personal information protection in China the status quo of legislation by analyzing the relevant documents and materials,can be found in our country gradually paid attention to the protection of personal information,however in the practice of violations of citizens’personal information is still frequent,the main reason is our country has not yet formed a complete unified personal information protection legal system.The fourth chapter puts forward suggestions to improve the personal information protection system in the prevention and control of public health emergencies in China,mainly from the aspects of legislative improvement,procedural regulation,the establishment of supervision and relief mechanism and the improvement of information protection awareness.
