| IUU fishing is an important cause of the depletion of fishery resources and fishery disputes in the South China Sea,and has become a real threat to the conservation and management of fishery resources in the South China Sea.The economic benefits of IUU fishing activities,the ongoing dispute over the delimitation of the South China Sea and the insufficient efforts of the surrounding countries in the South China Sea to jointly combat IUU fishing are all important factors that lead to the repeated prohibition of IUU fishing activities in the South China Sea,but the key point is that the South China Sea has not yet established a regional fisheries cooperation mechanism,and the countries around the South China Sea need to reach a consensus on this point as soon as possible to achieve common supervision of IUU fishing in the South China Sea and make the South China Sea fisheries sustainable.At the same time,based on the existing international legal framework for fisheries cooperation and the practice of the South China Sea Regional Fisheries Organization,it is proposed to strengthen the awareness of fisheries cooperation among the countries surrounding the South China Sea and to establish a regional fisheries management mechanism in the South China Sea to solve the IUU problem in the South China Sea.This paper takes the IUU fishing problem in the South China Sea as the research object,analyzes its impact on the fishery resources in the South China Sea,and puts forward constructive and perfect countermeasures.The article is divided into four parts:The first chapter discusses the concept,impact and causes of IUU fishing in the South China Sea.IUU fishing is illegal,unreported and unregulated fishing.In the South China Sea,IUU fishing behavior occurs frequently,causing a lot of adverse effects on the fishery resources in the South China Sea,such as leading to the reduction of fishery resources in the South China Sea,the South China Sea fisheries disputes and conflicts,exacerbated the tension in the international relations of the countries around the South China Sea,is not conducive to the management and conservation of fishery resources in the South China Sea.The reason for this is that the economic benefits of IUU fishing induce fishermen to take the road of illegal or even criminal fisheries,but the existing fisheries management mechanism in the South China Sea cannot effectively prohibit IUU fishing.Chapter Ⅱ reviews the international legal basis for fisheries cooperation between countries around the South China Sea to eliminate IUU fishing and the practical experience of existing regional fisheries organizations in the South China Sea.International instruments such as the United Nations Convention on the Law of the Sea,the Code of Conduct for Responsible Fisheries in the South China Sea and the FAO Compliance Agreement provide a legal framework for fisheries cooperation and control of IUU fishing in countries bordering the South China Sea.In addition,the many years of practice of regional fisheries organizations such as the Asia-Pacific Fisheries Commission,the Southeast Asian Fisheries Development Centre and the China-West Pacific Fisheries Commission have provided reference for the exploration of the South China Sea to establish a regional fisheries organization covering the countries surrounding the South China Sea.Chapter Ⅲ analyzes the main measures taken by the neighboring countries in the South China Sea to control the IUU.China,the Philippines,Malaysia,Indonesia,Vietnam and Brunei have all taken a series of measures against IUU fishing.At the national level,a system of detection,control and surveillance is in place to regulate IUU fishing,and internationally,international cooperation with neighboring countries or participation in regional fisheries organizations to combat IUU fishing.However,due to the old fishing legislation of the countries around the South China Sea,and the existence of imperfect or lack of fishing system,these measures cannot solve the IUU fishing problem in the South China Sea very well.Coupled with the different levels of economic development of various countries and the strength and weakness of maritime law enforcement forces,there is confusion and fragmentation of fisheries management in the South China Sea,which reduces the effectiveness of fishery resource management and conservation.Therefore,the neighboring countries in the South China Sea by the power of one country cannot eradicate the IUU fishing problem in the South China Sea,the South China Sea neighboring countries urgently need to strengthen fisheries cooperation to solve the plight of fishery resources in the South China Sea.The fourth chapter puts forward the proposal of fishery cooperation between the neighboring countries in the South China Sea.In order to effectively prevent,stop and eliminate IUU fishing,countries around the South China Sea need to establish a regional fisheries management mechanism in the South China Sea to improve the level of fisheries cooperation.First,there is a need to establish a regional fisheries cooperation organization dedicated to the South China Sea,secondly,the countries around the South China Sea should also improve the domestic fisheries management system in accordance with international law,and finally,we should strengthen the training and education of fishermen,deepen national awareness of IUU fishing practices,raise awareness of fishermen’s fishery resources protection,and enable the sustainable development of marine living resources. |
