Study On The Improvement Path Of Marine Living Resource Management From The Perspective Of Institutional Conflict

Marine mineral resources and Marine living resources are both important components of Marine resources and the embodiment of the most concentrated Marine economic activities at present.However,in the process of Marine mineral resources development and management,there are conflicts with Marine living resources,which affects the protection and utilization of the two kinds of resources and damages the rights and interests of relevant practitioners.This article through the study of Marine mineral resource management system,Marine biological resource management system,to find the conflict between Marine mineral resource management system and Marine biological resource management system,and find out the causes of Marine biological resource management system to improve the path,so as to reduce the conflict between the two,to provide reference for the sustainable development of our Marine resource management.In this paper,through the study of the current management system of marine mineral resources and biological resources,combined with specific cases in real life,it is found that there are conflicts between them in three aspects: ecological environment protection management,marine space use management and marine traffic management.It is manifested in mining discharge management system and fishery ecological environment protection management system,marine oil spill prevention and emergency management system and fishery marine ecological environment protection management system.Sea area use license management system and aquaculture license management system,sea area use license management system and fishing license management system.The conflict between the management system of marine production operations of engineering ships and the maritime traffic management system of fishing vessels,the maritime traffic management system of oil carriers and the management system of marine production operations of fishing vessels,through the further analysis of the causes of the conflict.It is found that the conflicts between the two in the protection and management of marine ecological environment include the lack of top-level design,the lack of supervision system,the lack of effective connection of maritime emergency management and the poor connection of liability mechanism.conflicts in the use and management of sea areas include the lack of unified planning for marine space management,the lack of unified division of marine functional areas,and the lack of public participation in sea area use management.The conflicts in maritime traffic management include the lack of unified planning of maritime passage and the lack of joint law enforcement mechanism of maritime traffic,and put forward corresponding countermeasures to reduce the conflict between them.realize the common sustainable development of marine mineral resources and biological resources,and provide a new path for the improvement of marine biological resources management system.
