Study On The Legislative Guarantee Of Optimizing Business Environment In Qinghai Province

Under the impact of covid-19 pneumonia,countries are looking for new breakthroughs in economic development.Especially in the face of the fact that international trade is hindered,countries are seeking new engines of economic development from their domestic markets,and optimizing business environment has become the best choice for countries in such a large context.Looking at China,the regulations on optimizing the business environment have been implemented since January 1,2020,and all localities have followed suit,seizing the time to formulate local regulations on optimizing the business environment,in order to provide institutional guarantee for optimizing the local business environment through perfect business environment legislation,attract more investment and accelerate the rapid development of enterprises.Under the demand of this era,improving the legislative guarantee system of local optimization of business environment is of great benefit to the improvement of the overall level of business environment in China.The complexity and regional characteristics of the business environment require that local governments should always adhere to the specific analysis of specific problems in the process of local legislation on the business environment,and integrate the local unique economy,culture and folk customs into the whole legislative system.Since the state authorizes local governments to have certain legislative power,when they carry out legislative activities,We should pay more attention to the life of local legislation,and put an end to the copying and uniformity of legislation.Since the implementation of the regulations on optimizing the business environment,the local provincial governments represented by Qinghai Province have been vigorously weaving local regulations on optimizing the business environment to adapt to the local economic development,focusing on the market environment,government services,supervision and law enforcement and legal protection,but not rigidly on this,and constantly exploring and innovating a legislative perspective suitable for the local.Of course,we should also clearly realize that there are some problems in practice,such as blind legislation,follow suit legislation,inapplicability of legislation and so on.These problems not only reflect the fragmentation of local legislation to optimize the business environment,but also reflect that the optimization of the business environment should take a long time to establish and improve various supporting systems.The main part of this paper is divided into four parts.The first part is the concept and composition of the business environment,which mainly expounds the basic theoretical knowledge of the business environment,including the definition of the concept of the business environment,and introduces the evaluation index system of the constituent elements of the business environment from the perspectives of theory and practice.On this basis,it analyzes the constituent elements of optimizing the business environment legislation in Qinghai Province.The second part analyzes the reasons for the problems of business environment legislation in Qinghai Province,mainly including the overall level and legislative process of business environment construction in Qinghai Province,and analyzes the deficiencies and reasons of business environment legislation in Qinghai Province.The third part compares and analyzes the business environment legislation of other provinces in China,and summarizes the legislative experience of other provinces from the perspectives of government affairs,market,rule of law and humanities,.The fourth part mainly aims at the problem analysis and experience summary of the above parts,improves the regulations of Qinghai Province on optimizing the business environment,and establishes a legislative guarantee system suitable for optimizing the business environment in Qinghai Province.
