Research On Administrative Legal Guarantee Of Optimizing Business Environment Of Local Government In China

On January 1,2020,the State Council regulations on the optimization of business environment has been initiated,business environment construction in the orbit,marked the optimize business environment increasingly attention,the country under the rule of law business environment construction is also on the agenda,has as an important system into national modernization of management system and management ability,from the legislative level to optimize the business environment provides a more powerful guarantee and support.Provinces are introduced under the call for laws and regulations and other normative documents,the author of 27 provinces about the business environment of the normative documents,analyzes the macro status of doing business in our country under the rule of law,and by doing good city for better than situation out two provinces and slightly difference of the two provinces,From the five aspects of market subject protection,market environment,government services,regulation and law enforcement,the analysis is divided into two levels of text comparison and practice comparison respectively,with the focus on grasping the micro status quo of the rule of law in local business environment.Based on the present situation of doing business in our country under the rule of law as a whole,the author find optimal business environment administrative law protection of existing problems,the main can be divided into three aspects: optimizing the business has not been formed in the process of the integration of environmental legal system,administrative law enforcement remained part of irregularities,the local business environment of the rule of law construction of information asymmetry,For example,a number of innovative measures have not been included in the scope of legislation,there are conflicts in the application of laws,the reform of delegating power and regulation has not been in-depth enough,the violation of laws and disciplines by public officials has not been completely curtailed,and local governments lack of cross-regional communication and cooperationIn view of the above three aspects,we should start from the legislative level,establish an integrated legal system to optimize the business environment,strengthen the synergy between departments and laws,and accelerate the legislative process of administrative procedures.Local rules and regulations should have local characteristics and conform to the regional development situation.Secondly,starting from the level of administrative law enforcement,the government’s administrative law enforcement behavior should be standardized,the examination and approval service mode should also be reformed,the responsibility investigation and fault tolerance mechanism arrangements should be clarified,the credit system construction should be accelerated,and the construction of a law-based government and an honest government should be vigorously promoted.Finally,establish a nationwide interactive platform for supervising and evaluating the optimization of the business environment with the functions of evaluation,supervision and interaction.
