On The Legislative Perfection Of National Park System Construction In China

National parks are the second largest type of nature reserve in ICUN,which originated from the United States and were followed by other countries in the world.Now they have become a kind of international nature reserve protection type and play an important role in the protection,utilization and cultural inheritance of natural reserve resources.At the beginning of the founding of the People’s Republic of China,national parks were not protected except in Taiwan,but were managed and protected separately according to different elements of natural resources.Now,the national park system construction of ecological civilization system construction in China has become an important issue.The establishment of national park had opened the curtain of the reform of the national park system construction in the third plenary session of the 18 th Central Committee,then 19 th National Congress and government introduced a number of policy documents to support the construction of the national park system,which had provoked extensive discussion that was about the development of the national park as the core system of natural protected area.National park pilot work has been actively promoted on a national scale.Some progress has been made in the construction,administration and local pilot legislation,but construction of our national park system still exist some issues,such as management system chaos,imperfect legal system and the safeguard mechanism,traced back,that are due to China’s vast territory and where has rich natural resource type,and long governance by the department of management system and the lack of legal guidance.Although China has incorporated the national park law into the legislative plan,the draft of it has not been promulgated,and the national park system construction is in urgent need of legal adjustment.In order to the construction of the national park system in China,The paper will analyze the deep reasons hindering the construction of the national park system from the two dimensions of the management system and the legislative system,and explore the way to solve the legal dilemma of the current national park system construction that is for promote legal system construction in China.The thesis is based on the experience of management and legislation in Chinese Taiwan,the United States and the United Kingdom,puts forward some Suggestions to improve the legislation in the national park system construction.Based on the practice of socialism with Chinese characteristics,try to explore conforms to the characteristic of national park system in our country,improving the management system of national parks,at the same time,legislative work need pay attention to improve the legislative status in the legislation,perfect the right safeguard system in the construction of the national park system,and define what the national parks act should contain.There is also a need to harmonize national park laws with related legislation,particularly with the nature reserve legislation.The comprehensive legal system is the overall train of thought,taking the law of nature conservation as the basic law and the law of national park and other special nature conservation as the special law,which is in order to provide reference for the early promulgation of national park law.
