Research On Legislation Of National Park

The establishment of the National Park is to better play its ecological function of regulating the climate,conserving water resources and protecting the biological diversity while utilizing the national park to realize its economic function.National Park,as an important part of the protected area system,keeps up with the trend of the times,tallies with the concept of sustainable development,and meets the requirements of ecology civilization construction.The foreign legislation practice of the national park shows the hyponymy relations between the protected area system and national park.Due to the unclear classification of the protected area system in China,the status of the national park in the protected area system is blurred.Although Yunnan Province has promulgated the Regulations on the Administration of Yunnan National Parks,and Qinghai Province also promulgate the Sanjiangyuan National Park Regulations(Trial),the lack of national park legislation at national level,gives prominence to low level of local legislation and lack of legislation system.After studies of the national park legislation in United States,New Zealand,South Africa,Japan,Russia and other countries,as well as that in Yunnan Province and Qinghai Province,this paper summarizes the origin and functions of the national parks;This paper states the relationship between the national park and protect area;This paper analyzes the existing problems including different opinions on concept of national park,non-standard of national park legislation,not in line with the international national park legislation and other issues,in order to lay the foundation and build legislative environment for the sustainable development of national park;This paper brings forward proposals on the standard of China’s national park legislation,the types of management mode,the expansion of funding channels,and the participation way of the community,aiming to further the national park legislation.
