A Study On Legislation Of National Parks In China

Since the establishment of the first National Park in 1982,time has been past 140 years,the National Park has become the most widely used protection mode in the world at present,its development also reflects the development from the individual to the trend of globalization.The establishment of national parks play an important role in the national environmental protection and in the management of National Park,from the start to mature in all stages of development reflects the environmental,economic and cultural aspects of the function.In our country,China's national park management system in terms of legislation or in practice which are fuzzy concept and scope,management confusion,legislation is not perfect,the reason is because the idea behind the lag of legislation,the power of the improper allocation of reality and historical reasons.From the perspective of comparative law,some foreign typical countries,such as The United States,Germany and Brazil.the National Park System in countries has very specific national conditions and National Park combining the concept of the rule of law,legislative mode formation are very unique,for example,independent legislative model specific national park,an area of a legislative mode,pay attention to personal and community interests of the specific system,it has an important reference value to improve the foreign experience to our country park in China's legislation and system.Specifically,the development and implementation of national parks legislation in China should focus on the improvement of park management system changes,follow-up legislation and the specific legal system in the park.At the aspect of the environmental management system in China,we should establish a scientific classification,unified national park management system and improve the legislation of National Park Based on establishing the legislative mode of National Park.The specific method in the National Park On the construction of the legal system,the following systems are the most important,such as the natural resources property rights system and paid use system,ecological compensation system,public participation system,the district management system and environmental management cooperation mechanism.
