As an important type of nature reserve,national parks are of great significance for managing natural resources,maintaining biodiversity,and achieving sustainable development.At present,my country's national park pilot projects are progressing steadily,and the National Park Law has been included in the legislative plan.Due to factors such as imperfect theories and insufficient construction experience in national parks in my country,national park legislation faces problems such as a huge legal system and complex interests.Research needs to be carried out on a holistic and systematic basis.In order to enable our national parks to exert their effective protection and utilization functions,it is necessary to discuss the top-level design of national parks and establish a reasonable national park law.The first part of this article clarifies the origin and concept of national parks.Analyze the definition,connotation and extension of national parks one by one,and analyze the connotation of national parks through the definition,characteristics and functions of national parks.In the process of analyzing the extension of national parks,the concept of nature reserves is introduced to clarify the relationship between national parks and nature reserves;the second part mainly introduces the status and construction of national parks in my country.By taking the status of the pilot construction of the Northeast Tiger and Leopard National Park as the starting point,we summarized the achievements of my country's national park construction,but faced problems such as unclear legislative positioning,overlapping management powers of competent departments,complex land ownership,and the interests of indigenous people;The three parts summarize and learn from the legislation and management experience of foreign national parks.The investigation of the legislative system and management system of national parks in the United States,Germany,and Japan provides a useful reference for the choice of the national park legislative system and management system in our country.The fourth part proposes the legislative idea of national parks.From the perspective of national park legislative positioning,general design,planning system construction,management system construction,and social participation system construction,suggestions for national park legislation are put forward.
