At present,China has entered an ageing society,and the aging population is accelerating,which has led to the rapid development of the“ health-care combination” industry,followed by a series of “ medical and nursing ” disputes and problems.The “ health-care combination ” service contract plays an important role as the core link of the “ health-care combination ” service.However,there is no legal provision in the current“ Contract Law” regarding the service contract of “ medical and nursing”institutions."The service industry also has no standard "medical and health"institutional service contract model,and the non-standardization of the"medical and nursing" institutional service contract has spawned many legal disputes,bringing law enforcement,"medical and nursing" institutions and the elderly The series of questions.The study selected 52 “ medical and nursing ” institutional service contracts in Heilongjiang Province,Jiangsu Province,Beijing,Shanghai and other regions.The results of the investigation showed that the existing “ medical and nursing ” institutional service contracts mostly existed as follows.Point problem: First,the definition of the subject of the two parties is not clear and non-standard;Second,the contract is not accurate in the positioning of the service contract of the "health-care combination";third,the rights of several parties that should be prescribed and must be specified in the contract And the content of the obligation is not perfect;Fourth,the contract is not perfect for the breach of contract and consequences of several parties.The article will combine the situation of China's national conditions,explore the theoretical issues in the service contract of "medical and nursing" institutions,standardize the subject,object,rights,obligations and breach of contract and consequences of the "medical and health" service contract,and serve the "medical and nursing" institutions.The introduction of the contract model provides references and recommendations.
