Research On The Value Of Chinese Awarded Patent Based On Patent Index

Intellectual property is becoming more and more important in the era of economic globalization and knowledge,and China’s intellectual property industry is booming.In order to promote building an innovation-oriented country and make intellectual property play a leading role in innovation,China has established the only award for patent from the government department——“Chinese Patent Award”,including Gold Patent Award and Excellence Patent Award.However,the industry insiders have questioned the evaluation process of the Chinese Patent Award and the patent value of awarded patents.They hold that most of the domestic award mechanisms adopt expert evaluation method which is affected by subjective factors and difficult to reflect the facts objectively.In view of the above problems,this paper uses the analytic hierarchy process(AHP)to build the index system of patent value evaluation and determine the weight of each index,quoting nine objective patent indexes including the number of patent family,the number of backward citation,the number of forward citation,the patent grand period,the age of patents when awarded,the number of inventor,the number of patentee,the number of claims,and the number of IPC4.Based on the patent information of 11 th to 20th(2009-2018)Gold Patent Award and Excellence Patent Award and 12th(2010),13th(2011),17th(2015),19th(2017)Chinese Patent Award and patents that participated in the selection but not awarded,this paper compares the patent value of Gold Patent Award with Excellence Patent Award and the patent value of Chine Patent Award with non-awarded patents.The principal component analysis and the Kruskal-Wallis test are used to test the validity of evaluation results.It is found that the patent value of Gold Patent Award is higher than that of Excellence Patent Award,and the patent value of Chinese Patent Award is higher than that of non-awarded patents.The number of patent family,the number of forward citation and the number of claims can effectively reflect the patent value of the invention.Finally,this paper suggests that the evaluation office of Chinese Patent Award quote such objective patent index in the evaluation process of awards.In this way,the objectivity and transparency of the awards can be improved,and patents with high value can be awarded.
