Innovation-driven strategy is the strategic goal of national development at this stage.Under this background,intellectual property strategy,as an important support and guarantee for innovation-driven strategy,has become increasingly prominent.Patents as a major method of intellectual property protection(IP)have also been paid more and more attention.At the same time,with the rapid development of emerging technologies and the rapid increase in the number of patent applications,a large number of pending patent documents have accumulated,and due to the enhancement of patents themselves,the professional quality requirements of patent examiners have become higher and higher.All of these made the examination more difficult.As the core of examination,patent infringement detection is the key to breaking through the bottleneck.But we can see that manual infringement detection is inefficient and error-prone.The automation of patent infringement detection can effectively improve efficiency,then the losses due to patent infringement can be avoided.Therefore,it is of great significance to effectively solve the problem of patent infringement detection.And in practical applications,in addition to one-to-one patent infringement issues,one-to-many and many-to-many patent infringement issues are often encountered.One-to-many and many-to-many situations reflect the denial of patents by patent collections.Patent denial rights help predict patent wars between companies,protect intellectual property rights and discover potential patent transactions.But at present,the automatic infringement detection technology is still in the exploratory stage,many challenging issues still need to be resolved.Based on this,this thesis proposes a patent infringement detection method based on game theory.Specifically study the following:(1)In order to calculate the patent infringement risk,this thesis proposes a patent infringement risk detection method based on dynamic game.This method uses technical features as evidence to determine patent infringement,takes the novelty and creativity of technical features as the principle of infringement determination,and simulates the patent review process based on a game theory model,and obtains patent infringement risks and evidence of infringement through games.(2)In order to calculate patent denial rights,this thesis constructs a patent denial rights network based on one-to-one patent infringement risks.Through the infringement relationship between patents and combined with the exclusivity of patents,we can calculate the denial rights of multiple patents against one patent and the denial rights of multiple patents against multiple patents.(3)This paper designs and implements a patent infringement detection system.The system includes four modules,namely a data preprocessing module,a patent infringement risk calculation module,a patent negation calculation module,and a user module.This thesis adopts a game theory-based method to detect patent infringement,fully considers the actual process of patent examination,which makes up for the shortcomings of the current method of treating the patent text as ordinary text.At the same time,the calculation of patent denial rights based on the risk of patent infringement supplements patent infringement situations.Experimental results show that this method can effectively identify infringing patents from several patents.It can be used in patent examination and patent war analysis.
