The Formation And Settlement Of Quality Disputes In Building Engineering

Recently,the disputed case of project construction contract is increasing gradually,which is accompanied with the increasing disputed case of quality of project construction.A multitude of problems are captivated by scholars including how does quality disputed case form,how to cope with the disputed case and how to prevent.This research is to narrow the knowledge gap in the context of the quality of project lasting for two years.The research begins with the defining the concept of the disputes on the quality of project then makes analysis on the solution in order to make the clarification in law regulations and contract rules.The attention is paid to the litigation.Considering mentioned above,construction quality of forensic is further studied.Then,the article studies the formation process of the quality dispute of the construction project through the referee case,summarizes the form of the quality dispute and the situation of the quality objection proposed by the employer.With the help of process of disputed case,the causes of the construction project quality dispute,including the direct causes,the indirect reasons and the root causes is generalized.Next,the primary focus is attributed to the quality of the property disputes,the main responsibility of the dispute,the dispute of quality responsibility.Moreover,the author studied the process of the quality dispute resolution based on the case in the court,including the identification of the project quality(whether quality defects existed),the identification of quality responsibility(who is responsible for the defects)and the way of accountability(how to take the responsibility).Finally,implication is suggested for employers,contractors,and consultants respectively.The author employs the referee case to reflect on the project implementation process,in order to figure out the crux of quality disputes and make recommendations for those who are responsible.This research shows great contributions not only to standardize the quality management in the process of project implementation but to improve the level of project quality management.Also,creating a law-abiding and honest and trustworthy market atmosphere is the first priority.
