Research On Legislation Of National Parks In China

National park system is the mainstream development mode of nature reserve in the world.It was first proposed by the United States and took the lead in national park construction.This mode has been used for reference by governments all over the world.National park development in our country starts late,after the third plenary session of the 18 th,the national park system construction become the important measure of ecological civilization system reform in our country,the national park system in many provinces,pilot good results,but the state allocated for lack of a national park construction in China is lack of effective legal support,and can’t reflect the national park system in the superiority of natural protected area protection.The absence of national park law leads to the priority of local legislation in the current pilot areas.The congenital defects of local legislation make the construction,protection and management of national park system in China face many difficulties.The pilot phase of national park construction is coming to an end,and the establishment of a formal national park means that the enactment of national park law is imminent,so the current study of national park legislation is of great value.Perspective,based on the comparative analysis research to the United States,Germany,Canada,three different development mode of national parks relevant aspects,the study found in national park construction ways to build the perfect national park,the legal system,management system and important legal system,to perfect our legislation of national park and the corresponding system construction has important reference value.At present,China’s National Park Law is in a blank stage,and it has not made clear provisions on legislative purposes,principles,modes,management systems and basic systems.Drawing on the experiences of foreign national park and local pilot results from a holistic perspective,China’s national park is the ideal legislation mode of integrated framework of legislation,but the lands allocated based around the first line of consideration,from the nature reserve construction integrity,systemic consideration,in the lands allocated for the nature reserve law reserved space in the future.In terms of the construction of national park managementsystem,a central vertical national park management system under unified management by the National Park Administration should be established,and the administrative authority of national park management institutions should be clearly stipulated,so as to improve the fund guarantee mechanism of national parks.In the improvement of the basic system of national parks,the land ownership system,franchising system and national park planning system should be innovated.
