Today, the development of information society is accelerating, the role of the media and public opinion guidance function in judicial cases reported are getting more prominent, this phenomenon is not only promote judicial openness and transparency, but also satisfied the demand of society’s requirement of knowing and supervising. However, due to various reasons of the cases, the commercial interests or social responsibility, the media staff is hard to reveal the truth of news, improperly intervene cases, make inaccurate judgment on the case, or make guilty deduction to all concerned. News of the first acts of this arrogation of judicial procedures is easy to spread false information, forming injustice atmosphere of public opinion, resulting in "trial by media" phenomenon, which might bring enormous pressure on the judiciary, impacting the trial.With the development of new media, forming a network and traditional media co-exist in the media environment, which would arose conflicts between Justice and emerging media. "trial by media" phenomenon has become increasingly evident, but also presents many new features. This article will use case analysis and text analysis and other research methods, based on recent onset of "Fudan poisoning case" and triggered the recall, "Zhu Ling thallium poisoning case", try to interpret the causes and negative impacts in the perspective of both the journalism school poisoning case, which reflect a "trial by media" phenomenon, and propose solutions to the problems exposed in this two cases, hope to provide reference resources to media report, standardized media reports, safeguard judicial independence.This thesis has five chapters: Chapter I ask questions, and "trial by media" and "Fudan poisoning case" in the relevant literature review, define and summarized the concept of "trial by media". The second chapter is to generalizing the "trial by media" phenomenon and its developing process, and make multifaceted discrimination of the "trial by media" and "public opinion", then analyzes the new environment of our country#s news media and public opinion supervision in the new media era, which establish foundation for the discussion below. The third chapter focuses on the two campuses poisoning case that reflects the new phenomenon of "trial by media" nowadays, the self media has become the starting point of information, Internet users the self-empowerment and crowd situation give birth to many "coax-off" and "judge"; the traditional network media set the agenda, sentenced without trial, misinformation, overstepped the judicial process, deviate from journalistic professionalism. Summed up the new media era of "trial by media" and the traditional "media trial" differences based on specific cases and the basis of text analysis. In the fourth chapter, author first introspect the new media era "trial by media" generated by the multi-angle reflection, and then also analysis on the "media trial" carried on the various negative effects summarized. The fifth chapter, the author gives four countermeasures in the light of the new media age, "trial by media", which looking forward to find solutions from their own, objectively and correctly guide public opinion.
