| The so-called media trial, which means the media report of-the judiciary that might bring certain impact to the judicial trial due to subjective tendencies. It is considered as border cross because of the excessive use of public supervision. Media trial may cause harm to the independence of the judiciary, damaging the parties in the case, thereby affecting the process of the legal community and the development of the society. At present, the media trial phenomenon is growing intensified. There is urgent need of a propitiate solution to the problem.The media trial has its historic characterization. It is also showing new features as the development of the new media technologies and the progress of the whole society. Therefore, at this stage due to the development of internet and other new media, the media trial should also be showing new features. In this thesis, the "new media environment" will be brought into the scope of the study. The new features of today’s media trial will be studied by using the media environment theory. Also the corresponding solution will be discussed.In the case selection, the typical case-Yao Jiaxin case, will be selected to analyze the specific contents of the case by using the qualitative research method. Then the new media trial characteristics will be summarized and analyzed in the new media environment of the judicial cases.When analyzing the new characteristics of the media trial, the lasted internet cases have been properly cited, like the Qin huo case, to prove the new features of the internet broadcasting of the news.In the chapter of the solution analyzing, the interdisciplinary analysis method is used, comprehensive analysis is illustrated to make full use of history, sociology, political science, psychology, communication and other aspects of the theory from the macro social environment perspective, the media operation angle, the news business angle, judicial system angle.At last, the related solutions have been discussed based on the analyzing. |
