Research On The Infulence Mechanism Of Media Trial In The New Media Era

Looking at some influential public events,from “Zhang Jinzhu case” “Deng Yujiao case” “Yao Jiaxin case” to the recent “Yu Huan case” “Jiang Ge case”,a large number of media reports and netizens' participation in the comments formed a strong public opinion pressure,which caused negative interference to the independent trial of the judiciary.In the new media era,the frequent occurrence of media trial has become a problem that our society and the public are concerned about at the present stage,and its phenomenon and the mechanism behind it have also attracted extensive attention from the academic circles.The study of the formation mechanism of media trial events can find out the micro factors of such events,so as to put forward suggestions and perfect the coordination mechanism between the public,the media and the government.Based on 25 hot news cases in China from 2016 to 2020,this study uses qualitative comparative study and analysis(QCA)method to construct the dual model of “communication attribute” and “event attribute”,obtain and explain the condition combination that forms the media trial through the Boolean minimization operation,and summarize the key variables and main condition combinations that affect the formation of media trial,to explore the internal mechanism and communication logic of the outbreak and evolution of such events.The analysis results of the QCA model constructed based on the “communication attribute” show that if news events are reported by the media and accompanied by rumors,opinion leaders guide public opinion,and when netizens are highly involved and generate public opinion tendencies,it will be easier to form media trial.Secondly,the intervention of opinion leaders and tendentious public opinion as a necessary combination of conditions exist in all media trial phenomena.This shows that the“framing” report of media is an important form of media trial dissemination,rumors are the catalyst for media trial,and the high participation of netizens will contribute to the phenomenon of media trial.Therefore,strengthening the governance and guidance of public opinion and regulating the words and deeds of opinion leaders are necessary measures for the government to prevent media trial.Besides,in terms of “event attribute”,if the news event itself has sensitive identity information and special plot,and the event-related information is vague,it will be easier to form media trial.Secondly,the case has a special plot,and the vagueness of case information,as a single variable necessary condition,is a key factor in the formation of media trial.Therefore,in the face of different types of cases,the government must take corresponding measures in accordance with the characteristics of the case itself,and do a good job in information disclosure and public opinion guidance.
