Since1950s, the phenomenon that the so-called "Trail by Media" began to occur at abroad and in our country. Especially in China, due to the different judicial systems to the western countries, the "trial by media" in our counrty has some peculiar phenomena and features. In this article, the study of the" trail by media" will be made based on the development of period.At first, based on the significant changes of the "media trial", the article divides this phenomenon to three stages:The first stage is the beginning of the establishment of China’s reform to the reform and opening-up. The second stage is the reform and opening-up to the early twenty-first century. And the third stage is the beginning of the21century till now.Then, the article will choose some typical cases. By using the communication framework of the theoretical research, the article will analyze the disseminator, the communication content, the audience and the communication effect. Incorporation of law, psychology, and other disciplines related knowledge, the development and characteristics of each period "media trial" phenomenon will be carried specific analysis.The article argues that at the first stage, the "trial by media" was based on the need of political movement. The phenomenon launched by the media, the leaders involved in high. And the judicial far-gone followed the public opinion, news and judicial professionalism had been ignored. At the second stage, the "Trial by media" was based on the need of oversight responsibilities by social media. Media reports returned to the dissemination of information on their own, through the "agenda setting" to guided public opinions, and affected the outcome of the trial by the "hidden power". At the third stage, the subject of the "Trial by media " shifted from traditional media to the network platform. Each one who uses the web could became a participator of the "Trial by media " since the advent of the "We Media" era. The official sound was out of the hope to meet the needs of the audience to get the information,and as well as to keep people’s sanity.But the questioning and anxiety about the public rights and the violent face of the online world were also reflected most vividly.Finally, based on the theory of audience self-correcting, the speeding up of the judicial publicity process, and the increase of the costs to the disinformation costs, the article argues that, in the future the "Trial by media" will gradually disappear, and public opinion will be more sensible.As the existing study of the "Trial by media" in the country, mostly confined to the analysis of a case carried in a certain period. I hope to show the whole picture of the development of the "Trial try media" in our country, so that readers could have more comprehensive knowledge and understanding and could make an objective and scientific evaluation.
