A Comparative Research On Library Websites’ Copyright Policies Between British And Chinese University Libraries

In recent years many domestic university libraries encounter copyright disputes. These university libraries receive warning, or even are to be appealed to law as a defendant. The copyright disputes are mainly due to some irregularities which happen in the use process of electronic resources. The occurrence of these violations not only brings a lot of inconvenience to the user, but also causes great loss to the university library, and even affects the library’s daily work and the reputation of the school. Domestic libraries’Copyright protection work faces the unprecedented challenges. Copyright Issue is increasingly becoming one of the key factors influencing the harmonious library construction. The following problems have to be thought through and solved by the university libraries:How to effectively prevent and stop the infringement? How to better balance the interests between copyright owners, users and the library? How to protect the library’s lawful rights?At first, this paper introduces the research status of library copyright issues by the domestic and foreign scholars, and then points out the shortage which exists in the study of library copyright issues by the domestic scholars. Secondly, it introduces the Chinese and British copyright laws and regulations related to library, then compares and analyzes the advantages and disadvantages of bilateral copyright laws and regulations in the aspects of library copyright protection. Then the third part analyzes the status quo and contents (including copyright ownership, the description of Copyright material, legal basis, the scope of authorization, fair use, the form of infringement, tort processing, notification and remove policy and disclaimer.) of the website copyright policy in the twenty university libraries, and summarizes the respective advantages and disadvantages of copyright protection in British and Chinese libraries. The part is the focus and core of the full paper. Finally, the fourth part provides some positive countermeasures for domestic university library copyright protection work, mainly including perfecting legislation, giving play to the role of the university library alliance, increasing the funds investment of the library, and establishing perfect copyright protection mechanism (prior control, on the spot control and afterwards control).
