China is a critical and sustainable period of building an innovation-oriented country in the 13th Five-Year Plan, Design around Patents are in a research hotspot that focus on the field of engineering design methods. It’s very important for Design around Patents to improve the core technology and key technology of independent intellectual property rights in China.It also can save time and save cost,and finally avoid the other’s patent rights.In the paper, as to the immature theoretical exploration of Design around Patents, single design solution and TRIZ how to take advantage of itself in Design around Patents, it proposes a technological route of Design around Patents method that based on SAPB binding IPTECH platform and TRIZ theory that improve plan in which all researches are as follows:1) First, the key of Design around Patents is complete and accurate database of patent search strategy. IPTECH platform combined with WEBPAT database for the research platform to study the intelligent search strategies and the general search strategies how to ensure patents’ considering full rate and considering accurate rate. IPTECH platform adapts four types of patent map to design around patents. It’s comparative to grasp the object of evasion in current industry trends, and to find the patent minefield, then to find gaps of Design around Patents in research.2) In the paper, to establish the roadmap of core technology of Design around Patents is based on the establishment of Avoidance Matrix System Tables that presents its efficacy and applicable. The establishment of distinguishing the new system from the old system to establish technical methods and technical elements which are summarized by German Systematic Approach, then screened by a combination of morphological matrix methodology to get more design schemes.3) The study finds that SAPB theory and TRIZ theory are incorporated in global and local relations of Design around Patents. To establish Avoidance Matrix System Tables based on SAPB theory to circumvent primaries solutions and grasp the overall technical solutions. However, TRIZ theory solves the technical means or improves functions.4) The study analyses that infringement determination of patent law on the legal level,which finds the interface to combine with avoiding scheme of methodological level in technical route. If avoiding scheme of technical solutions on the methodological level does not comply with infringement determination of patent law on the legal level that infringes others’ patents, then to redesign technical methods and technical elements from Avoidance Matrix System Table, thereby to perform a new round of design solutions.5) To verify the feasibility of the technical route of basing on SAPB binding patent maps of IPTECH platform and TRIZ theory that improve plan.To illustrate the sorting machines of waste as the object of evasion and use this technical route in detail to study how to successfully circumvent others’ patents, finally to propose the application of patents.
