Research And Application On The Group Of Competitive Patents Design-around Based On TRIZ

In the era of knowledge economy,the innovation has become the main melody of social development.The intense of market competition shows the intellectual property competition.Enterprise can get the sustainable development only by constantly technology innovation.However,more and more patent barriers make enterprise development's technology space get smaller and smaller.Patent design-around which is an aggressive patent strategy,not only can full comprehended the newest technical connotation and development trend,but also can develop with independent intellectual property rights of new techniques and new products,avoiding the occurrence of patent disputes and infringement.The current patent design-around is primarily aimed at a single patent and a group of patent.Although it is possible to obtain a design structure that is expected to be expected by the design,it is likely that there will be infringement of other similar patents when a single patent is circumvented.There are some regular patterns in the process of deriving a patent from a single patent,and the methods of circumvention of the patent groups generated by different derivations are different.Aiming at some shortcomings in the current design method,this paper proposes a design-around method of the group of competitive patents from the perspective of patent group classification.The main contents of the thesis are as follows:1.Through the analysis of the evolution of product family and the analysis of enterprise patent distribution strategy,we find the derivative rule of patent,which divides the patent in the target patent library into three categories: the group of competitive patents,the group of complementary patents,the group of extensibility patents;2.This paper analyzes the method of the group of competitive patents,through analyzing the technological development route of technical system and summarizing the current situation of technology development,we can explores innovation opportunities,determines the avoidance goal and avoids the direction,and uses the patent value calculation model to select the high value of the patent composition the group of competitive core patents.3.On the basis of the group of competitive core patents,a method of determining the scope of the patent group is proposed.Through the extraction of the information of the patent document,the component relation matrix is established and the component-function-action type table is established to determine the circumvention range and the TRIZ tool The problem gets a new plan and is determined by tort.4.By applying the contents of the above research,it is necessary to identify the group of competitive patents of the company,to determine its avoidance target and to avoid the scope,and to avoid the design of the scope,verify the correctness and feasibility of the method.
