Nowadays, with the further deepening reform of Chinese medical and Sanitary system, China reformed in the medical services systems variously with a daring attempt across the country. and explored actively to form the new reform model. From the point of institutional reasons, the unsoundness of medical services regulatory system is an important reason for appearing lots of new problem in medical services market.In order to implement the new medical reform program, Chinese five ministries released the " guiding opinion about the reform of public hospitals " jointly in February2010,which explicitly proposed "strengthen the supervision function of the health administration (including Traditional Chinese Medicine) in medical services, establish and improve medical services supervision mechanism, enhance the supervision with the safety and quality of medical services in public hospitals, strengthen the supervision of public hospitals operation, create social participatory regulatory system, full play the supervisory role of all sectors of society to face the public hospitals."It showed that the establishment of sound health care services for medical and health system became a part of the regulatory system reform in China. Medical reform of China in recent years begun to emphasize the importance of corporate governance in public hospitals, and attempt to carry out the corporate governance reform. Corporate governance of public hospitals has been a hot topic in the field of the medical reform and hospital management. Therefore, the corporate governance of public hospitals in China is closely related to medical reforms, and the implementation of corporate governance is imperative. Corporate governance of public hospitals in China existed many problems such as, the legal status is not clear, the tubes do not separation, the government also serves as the donors and the supervisers. The supervision of public hospitals is one of the important issues of corporate governance to be solved. Thus, in the context of the new medical reform, the establishment and improvement of the regulatory system of public hospitals are very significant.Public hospitals in China accounted for71.1percent of the national health agencies to assume more than90percent of the medical services, and dominated the country’s health service system, and played a very important role in disease prevention and treatment as well as people’s health protection. Because of the special market conditions, the public hospitals has been an unprecedented opportunity for development, and are constantly expanding and play an important role increasingly. Supervision of the public hospitals, however, failed to achieve the desired effect. The benefits demand of public hospitals and the health care costs rising seriously, this highlights the incoordination of our country’s health service system with regulation system.At present, the problems of medical and health services in our country were that: First, China had not yet established a complete regulatory legal and regulatory framework though existing a certain number of administrative regulations, departmental rules and regulations and normative documents, the medical services industry’ standards, technical specifications. Second, the regulation functions of public hospitals scattered in a number of administrations, and hospitals were multi-regulated. At the same time, the price department, National development and reform commission, as well as financial sector supervise the hospital, the health sector and other sectors between the ultra vires and the intersection of the rights of making the division of labor is not clear, the lack of effective communication and co-operation system will bring a lot of difficulties to the regulator. Furthermore, the regulatory mechanism is not enough that external regulatory capacity is weakaisolack an effective system of accountability, abuse of rights of the regulatory response measures can not guarantee that the administrative enforcement of the fair and equitable, the same time, regulatory actions is not clear review system, causing Without limiting the rights of the regulatory authorities, which lost control and supervision of public hospitals. Finally, the existing medical services market, lack of self-regulatory capacity. Because our health care system was imperfect, the immaturity of the market mechanism, market regulation and weak,In the rapid development of society, counties around the world not only emphasize the importance of public hospitals, but also attention to the reform and improvement of the regulatory system of public hospitals. Variety of existing national regulatory model.because levels of development of the economic, cultural, social are different, regulatory system and reform of public hospitals content has differences; British and Australian model change and improve the supervision of government intervention, macro, the United States is the main mode of operation of the health care market supervision.Because of the special circumstances inin China, there is rapid economic development all over the country’s, but the gap between rich and poor is significant t, levels of provincial and municipal health care are still different. Now, with the development of further medical reform China’s medical reform further and major comprehensive reform of the institutional mechanisms for the Pilot, in some areas, such as Shanghai, Shenzhen and other places began to explore the new governance model for public hospitals, in practice a new model attempts to separate management from operation and have got some successful examples worthing to learn. However, in most areas of the health sector and public hospitals are still using the traditional mode of regulation and governance, many issues to solve at this stage of medical and health services industry must start from the system to change the traditional mode.The regulatory problems in Our public hospitals as follwos:①rough control of the public hospitals, the regulators did not pay attention to improving the management capacity of public hospitals, lacked incentives and constraints on public hospitals, and supervision and operation of the hospital development was inadequate, so the hospitals could not full realize the damand of government and society.②medical services lacked an effective clinical treatment guidelines.③the health sector, although the makers of regional health planning and regional medical institutions to set up the planning system, lacked the legal guarantees of planning due to the management system, medical service was difficult to implement.④The face of the highlights of the benefits or reduce the problem of medical services, the Government has a lack of effective means of control and measures.⑤As China’s shortage of medical resources and layout of the imbalance, the professionalism of the medical technology and treatment outcomes are uncertain, both supply and demand information asymmetry, so that awareness of the health care process measures and medical expenses and recognition in both doctors and patients were different, resulting in many medical disputes which should not happened.Based on the problems under supervision of the public hospitals in China, this study had put forward policy recommendations for the establishment and improvement of the regulatory mode of public hospitals in China:First, in the external supervision of the public hospitals, regulatory legal system should be established; built efficient government regulatory regime; built government and the market to co-monitor mode; establish and improve social pluralism medical service monitoring functions; establish medical quality and safety control system. Secondly, in the internal control, improve related regulations, institutional design in public hospitals; innovate governance mechanisms in public hospitals; promote the construction of medical information, and increase the transparency of health care services.In recent years, medical and health resources in Guangdong Province expensed in the number and size, at the same time, there were also the problem of low health care resource utilization and declining fair. Public hospitals in Guangdong Province had the rapid growth of economic efficiency, but also the adequate regulatory and decline socia effect. The problems related with the livelihood of the residents, which not only affected the citizens’ health, but also brought a series of discordant social issues. Therefore, the medical service system in Guangdong Provinceneed reform urgently.With further promotion of medical reform in the Guangdong,, the medical reform of the pilot cities, in2010, Development Research Center of Guangdong Province of Guangdong Provincial People’s Government established "in public hospitals mode reform of corporate governance structure " as the major decision-making consultation of the2010People’s Government of Guangdong Province project. In November2010, the study authors to follow the group to Shenzhen, Zhuhai, Zhongshan and other researches around the health reform status quo, outcome and public hospitals, corporate governance structure to run the status quo. This research paper was divided into five chapters. The first chapter elaborated on the domestic and international research in this study the content, purpose and methods. The second chapter analysised the supervision of the public hospitals with the existing problems and related theory, from the background of public hospitals, regulatory model system. Chapter III comparative study of the existing regulatory model for public hospitals at home and abroad, through the study of foreign China can learn from the experience of our country’s public hospitals and regulatory approach is a comparative study. Chapter IV, taking Guangdong Province, Shenzhen, Zhuhai and Gaozhou public hospital regulatory approach as examples, research empirically. The fifth chapter discussed on the establishment and improvement of supervising public hospitals.
