A Study On The Current Situation And The Countermeasures Of Travel Agency's Domestic Tourism Contract

A travel service's domestic travel operation is the main business of travel service in China. Travel service signs the operation contracts with other tour product suppliers and traveler for accomplishing a tour. Our country's travel services'operation contract is in confusion now. The contract between travel service and other tour product suppliers is not clearly defined in terms of right and obligation. We have no enough insurance available,supply chain management falls behind .The author adopts case study and comparison research methods to research our country's travel service operation contract's development process and current situation, analyze the problems existed and the reasons behind the problems, and give some suggestions to solve the problems.The main reasons fall into the following aspects: the tourist and travel service law consciousness falls behind; the legal system of tourist and travel service falls behind; insurance is short of competition and part of trade monopolies (air service industry and railage industry). The author brings out the suggestions to make the service contract perfect between travel service and other tour servers. These countermeasures include: (1) raising the tourist and travel service law consciousness step by step; (2)reinforcing tour legislation;(3)enforcing the law, and judicial construction(;4)improving and perfecting the kind of Insurance(;5)sharpening the industry cooperation and making the supply chain of tour management better. In the other hand, the beneficial means of making the travel service operation contract better is improving and perfecting the form contract that tourist and travel service sign.This article changes the notion of researching tourism contract only, when people study the travel agency contract, but puts the tourism contract as a part of travel service operation contract. It also points out that a well defined tourism contract and travel service operation contract are the basis of protecting tourists'right and making tourism market standard. The two contracts influence and promote each other.
