Independent travel,which is known for its variance,economy,flexibility and full of adventures.is favored by many tourists,especially the youth.Thus,it enables such way of travel to become the one that may rival with the traditional package tour.Nevertheless,as independent travel is one of the rising businesses in China,not many laws and regulations are made to solve the disputes over such new business,so that our domestic courts do not know where to begin in when confront cases about independent travel.In most cases,the court has to analyze in aspect of jurisprudence to deal with cases respectively,and,often,can't give out a convincing judgment After several years' careful study in many cases,the writer intends to explore in these following aspects:The thesis begins with a brief introduction of the first dispute over the independent travel and the judgment.Reflecting on the case,the author leads out the topic of the thesis,i.e. the legal responsibility of the organizers of independent travel.;In the second part,the nature of the independent travel,that is analyzed over the process of the progress of independent travel;In the third part,the obligation of the organiser is propsed,and the legal basic of the obligation is well analysed.;In the forth part,a legal principle,which deals with the disputes may happen in independent travel,is summarized by studying the existing laws and cases about tourism in the USA.By comparing this with present conditions in China,the writer offer selections of some quintessence to enrich the legal measures in independent travel,to handle such cases;In the following part,five suggestions concerning the present conditions of the organizers' taking legal responsibilities are raised;Finally,the sixth part gives a summary about the main perspectives of the thesis and reaches a conclusion.
