With the rapid development of real estate, the market demand on property service is increasing continuously, as a new kind of service industry. However, the development of property service industry is intermingled in both good and bad situation, because of its low entrance standards and imperfect law system etc. It is under this background that property hidden rules occur. Among many reasons of causing property hidden rules, the lack of legal system of property service should be concerned particularly. How to improve the property management system of China and how to solve those problems including property hidden rules efficiently? According to them, this article makes some considerations: Firstly, by analyzing the fair trading rules, based on the ownership of building distinction, which is established by the property law, it has made a theoretical groundwork for improvement of our property management system; Secondly, it also expatiates on the present status of the property management system operation and the existing problems, by comparing the rules of oversea property management and the current domestic legislative status of property management; Thirdly, it points out shortcomings of the current property management system, by analyzing the source of property hidden rules; Finally, it discusses on how to improve the property management system of China.Specifically, this article is divided into six parts:Part one leads to the main thrust of this article by analyzing the phenomena of hidden rules. Part two introduces the composing theory of building ownership. Brings forward and studies the management right of building under the guidance of this theory; Part three compares the property management of different countries and the development overview of property management in our country.Part four makes a further analysis on the reason of property hidden rules and points out the shortcomings of property management system. This part discusses respectively on these four aspects: preliminary property management system, owners autonomy system, position of property service contract parties, and administrative supervision system;Part five puts forward legal suggestion to improve the legal system of property management of China;Part six summarizes this article briefly.
