"Trial By Media" And It's Legal Stipulation

In recent years, the problem of "trial by media" has become a hot point of same solicitude in academy circle. A lot of scholars give sharp criticism to the "trial by media" , they think the media report and comment of the judicial activity will easily form "trial by media" . Of course , there are some scholars also think that the conception of "trial by media" is not scientifical.First, we show that the improper intervention into justice by the Chinese media with some typical cases. Second, we ask for help from the western' system and codices . On this foundation , we try to look for some balance point between court and media. The last part comes back to the reality in China. However, we should contact concrete state of the nation of China while drawing lessons from the successful experience of the abroad. It is vital to improve the systematic environment in China for the supervision over justice by the media as there is still serious lack of legislation in this field. So, the author advance the construction of "the contempt of court" .
