Research On Personal Information Protection Under The Background Of Public Health Emergency Response

The major victory in the face of the novel coronavirus epidemic shows great progress in China’s emergency legal system.Looking back at the past three years of COVID-19 prevention and control,we can learn a lot from the experience and inspiration.Public health emergencies are challenges and tests to the construction of rule of law and social governance.Cutting-edge technologies such as big data,while helping governance,also pose security risks.Personal information protection presents new characteristics and new requirements under the new era background.In public health emergencies,the "identification characteristics" of personal information have been significantly enhanced,the limited legal protection of personal information has been highlighted,and the consequences of personal information being infringed have become more harmful.The urgency of personal information protection has intensified in the response and management of public health emergencies.Our country has formed a unified system of personal information law regulations and constructed a relatively complete framework at the legislative level.In the context of public health emergencies,it also forms a relatively good connection with emergency laws and regulations.However,there are still some problems that principle and generality cannot be applied in specific and complex scenarios.In the practice of responding to public health emergencies,there are also some personal information protection problems,such as excessive collection phenomenon in the information collection link,fuzzy information disclosure link subject,lack of personal information processing norms after public health emergencies,and personal information infringement relief mechanism to be improved.How to strengthen the protection of citizens’ personal information while ensuring the efficient and orderly response to public health emergencies is worth thinking about.Exploring the balance between public interests and citizens’ personal information rights and interests is also the due meaning of dealing with public health emergencies.Starting from the challenges faced by the protection of personal information,this paper puts forward some measures and suggestions,such as effectively maintaining the basic principles of personal information protection,clarifying the subject of information disclosure during the epidemic,clarifying the handling norms of personal information infringement,desensitizing citizens’ personal information disclosure,and establishing a personal information classification and grading mechanism.Strive to collect and process information in an orderly manner under the framework of the rule of law,give citizens a sense of security,protect citizens’ personal information rights.
