Research On Personal Privacy Protection In Public Health Emergencies

Government information disclosure is the necessary meaning of building a law-based and sunny government,but the protection of personal privacy should not be ignored in the process of information disclosure.Especially when a public health emergency occurs,government information disclosure plays a significant role in controlling the spread and spread of the epidemic,which is an effective means to deal with the epidemic and maintain public health and safety.However,during the prevention and control of public health emergencies,there are also many criminals who take advantage of the opportunity to steal and leak citizens’ personal privacy information,resulting in a great threat to citizens’ privacy.Therefore,it is necessary to make a specific analysis of the problems faced by personal privacy protection in public health emergencies,and combine with the actual situation of China,selectively learn from the personal privacy protection system overseas,and put forward targeted personal privacy protection measures,so as to effectively respond to public health emergencies and maintain public health and safety at the same time.Citizens’ personal privacy shall be protected from illegal infringement.In addition to the introduction,this thesis is divided into four parts.The first part focuses on the basic theory of personal privacy protection under the background of public health events,including the basic concepts related to public health emergencies and personal privacy,the contradiction and balance between government information disclosure and personal privacy protection,as well as the characteristics of personal privacy in the background of public health emergencies.The second part mainly analyzes the personal privacy protection issues involved in government information disclosure in public health emergencies.For example,the subject of privacy information collection is too broad,the scope of privacy information disclosure is not uniform,the measurement standard of public interest is not clear,the management and supervision mechanism of government information disclosure is not sound,and the relief after personal privacy is infringed is insufficient.The third part mainly introduces and analyzes the personal privacy protection systems in the United States,Germany and Japan,and draws on their beneficial experience in personal privacy protection,which provides some references for the study of personal privacy protection in public health emergencies.The fourth part mainly according to the above analysis of the problems,gives some suggestions for improvement.Specifically speaking: First,the collection subject of privacy information should conform to the provisions of the law,and should clarify the measurement principle of public interest,and unify the standard of privacy disclosure to ensure that the privacy of individuals in public health emergencies is not infringed illegally.Secondly,we should improve the management and supervision mechanism of government information disclosure in public health emergencies.By improving the personal information collection and management system and attaching importance to the social supervision role of the media and the public,citizens’ personal privacy is protected from illegal infringement and citizens’ legitimate rights and interests are safeguarded.Finally,the relief mechanism for individual privacy protection in public health emergencies should be improved.We should not only improve the system of suspension of execution of reconsideration or litigation,so that citizens’ rights can be protected in the process of case hearing,but also improve the system of damage compensation for infringement of personal privacy in public health emergencies,so that the protection of personal privacy can be fully implemented.
