Study On The Legalization Of Co-governance In The Public Health Emergencies

The legalization of multiple co-governance of public health emergencies is a modern path that takes plural subject as the main body,co-governance as the means,legalization as the guarantee,and the way of legislation,law enforcement and legal liability to deal with "public health emergencies".In the process of emergency management of public health emergencies,the multiple co-governance of public health emergencies requires the government,medical institutions,grass-roots social organizations,citizens and other multiple subjects to play different types of roles.In the extension form,the forms of multiple co-governance in different stages of public health emergencies are interlinked.Based on the study,it is found that the two are mutually unified and promote each other.However,multiple subjects also have some problems,such as the ambiguity of the rights and obligations of social forces,the unclear provisions of the status of the government,the scope of the transfer of citizens’ personal information protection without the legal basement and so on.Through the study of the legal system of public health emergencies in the United States,and the analysis of the reasons why the United States,which is advanced around the world in medical treatment,failed to deal with the COVID-19 pandemic,it is concluded that trust and cooperation between the social force and the government is the only choice to deal with the pandemic.First,we need to improve the legislative process for multiple subjects to participate in the governance of public health emergencies,clarify their rights and obligations in order to strong the law enforcement,and improve the relief and security system of social forces to ensure the legitimate rights and interests of social forces.Secondly,under the “Special Control State”,by defining the boundary of the government power,clearing liability coverage,regulating government’s performance,can China realize the expectation of good governance when facing the predicament of public health emergencies.Finally,it is necessary to attach importance to the protection of citizens’ personal information,clarifying the personal information collection subject qualification,limiting the protection period of personal information By adding epidemic prevention and control clauses to relevant laws so as to achieve the purpose that citizens’ personal information can be effectively protected during and after public health emergencies.
